CAFC Sends IEEPA Case Back to CIT
to Begin Process to Issue Refunds

The U.S. Court of Appeals for the Federal Circuit (CAFC) on March 2 granted a motion for immediate issuance of the mandates in the lead cases on the legality of tariffs imposed under the International Emergency Economic Powers Act (IEEPA). In a separate order, the CAFC sent the case back to the Court of International Trade to solve the issuance of IEEPA tariff refunds. The government maintained that the court should wait the usual amount of time before issuing the mandates or stay the issuance until Congress could provide a solution to the issue of tariff refunds, but the CAFC chose to decide against these objections.
