The Impact of the CAFC Decision of Sunpreme v. United States on CBP Decisions to Unilaterally Assess AD/CVD Duties

With the recent announcement of a potentially new 4th Tranche of duties on Chinese products effective September 1st, the President’s tweet on the possible application of an additional 10% surcharge on Chinese products, and with no immediate end in sight, exploring legitimate strategies for duty reduction or avoidance is of paramount importance to businesses today.

There are numerous false ideas about what constitutes substantial transformation, including changes in tariff classification or value-added rules. Importers and senior management will naturally turn to its Customs broker and in-house customs and logistics staff for advice on ways to weather the storm. Be ready with sound advice and options!

Finally, how does the May 2019 CAFC decision in Sunpreme v. United States affect the treatment of goods suspected by CBP of being subject to AD/CVD duties? In Sunpreme, a majority of the court held that CBP lacked the authority to assess AD/CVD duties on its own unless the goods are “unambiguously covered by the scope of the order.” What does this mean for CBP and importers, particularly for importers faced with a CBP-28 or CBP-29 and a decision whether to file a Prior Disclosure or not?
