USTR Publishes China List 3 Exclusion Instructions

The USTR has published instructions for submitting exclusion requests for List 3. Here’s what you need to know:

1. The web portal (http://exclusions.ustr.gov/) for submitting exclusion requests OPENS June 30, 2019 at noon EST and CLOSES on September 30, 2019.
2. Parties requesting exclusions must register at the portal prior to submitting exclusion requests.
3. Requestors may submit a range of comparable goods within the product definition set out on the exclusion request. A product request may include two or more goods with similar product characteristics or attributes.
4. It is recommended that parties prepare, and submit detailed information requested on the form. A copy of the form can be found here.
5. Granted exclusions will be effective going back to Sept. 24, 2018 when the tariffs on $200 billion in goods from China were implemented with a 10% tariff.
